Please take the time to read and understand the booking conditions set out below prior to booking a trip with Chile Off Track.

⊕ Our Contract: All bookings are made with Chile Off Track (us/we). By booking a tour with us you are deemed to have agreed to these Terms and Conditions (which constitutes the entire agreement between you and us) and your booking will be accepted by us on this basis.

⊕ Liability Waiver: By booking one of our tours you certify that you have contracted private health and travel insurance and that you do not rely on any type of insurance provided by Chile Off Track or third related parties. To fill out our Liability Waiver form please click here.

⊕ (Semi-) Private Tours: All bookings are (semi-) private which means that, unless we receive another reservation for that same day for that same tour, your booking is private. If you want your tour to be completely private an extra charge might apply, especially in our high season!

⊕ Day Tours – Booking and Cancellation Policy: 

  1. Cancellation Terms:
  • Cancellations made 48 hours or more before the scheduled pick-up time (e.g., 10:00 AM) are eligible for a refund, minus a 3% processing fee to cover payment platform charges.
  • Cancellations made within 48 hours of the scheduled pick-up time, or in the event of a no-show, are non-refundable and incur 100% of the tour fee.
  1. Rescheduling:
  • Rescheduling is only permitted if requested at least 48 hours before the scheduled pick-up time. Rescheduling within 48 hours will be considered a cancellation, and the full tour fee will be forfeited.
  1. Refund Processing:
  • Refunds will be processed within 10 business days after receiving a written cancellation request. Refunds will be credited to the original payment method, minus a processing fee of 3% of the total amount. Chile Off Track reserves the right to delay refund processing beyond this period in cases where unforeseen operational disruptions occur (e.g., platform or bank issues). In such cases, the client will be notified in writing.
  1. Force Majeure:
  • Chile Off Track shall not be liable for any cancellations or rescheduling due to force majeure events such as, but not limited to, natural disasters, pandemics, government restrictions, or civil unrest. In these instances, no refunds will be provided. We will, at our discretion, attempt to reschedule the tour or provide a credit for a future booking within 12 months of the original tour date.
  1. Refund Eligibility:
  • Refund eligibility is strictly subject to compliance with the cancellation terms above. No exceptions will be made for medical issues, flight cancellations, or any other personal reasons unless trip insurance has been purchased. Chile Off Track strongly recommends purchasing comprehensive trip insurance.
  1. Non-Transferable Deposits:
  • All deposits are non-transferable and cannot be applied to future bookings or different clients.
  1. Third-Party Vendor Clause:
  • If cancellations or changes occur, Chile Off Track is not responsible for third-party vendor costs, such as accommodation or transportation.
  1. Chargeback Prevention Clause:
  • By booking with Chile Off Track, the client agrees to abide by the terms of this cancellation and refund policy. Chargebacks initiated against payments made in accordance with this policy will be contested, and legal action may be pursued

⊕ Longer Tours / Large Groups – Cancellation policy & Payments:

  1. Payment Schedule:
  • Down Payment: A non-refundable down payment of $500 is required to secure the trip itinerary. This amount will be deducted from the total cost.
  • Deposit: A deposit of 50% of the total trip cost is required after finalizing the proposed itinerary. The down payment will be applied toward this deposit.
  • Final Payment: The remaining balance is due 40 days prior to the trip’s start date. Failure to pay the balance in full by the due date will result in automatic cancellation, forfeiting the deposit and down payment.
  1. Cancellation Terms:
  • Cancellations made 40 days or more before the trip start date will result in a 75% refund of the deposit per person, minus any non-recoverable third-party costs (e.g., hotel deposits, permits).
  • Cancellations made within 39 days of the trip start date are non-refundable. No refunds will be given for last-minute cancellations, early departures, or failure to attend the tour, regardless of the reason.
  • Non-recoverable Costs: Chile Off Track reserves the right to deduct any non-recoverable costs from the refunded amount (e.g., third-party deposits, vendor penalties).
  1. Refund Processing:
  • Refunds will be processed within 15 business days after receiving a written cancellation request. Refunds will be issued to the original payment method, minus any non-recoverable costs and processing fees of 3% of the total amount.
  1. Force Majeure:
  • In the event of force majeure (natural disasters, political instability, pandemics, etc.), Chile Off Track will not issue refunds. We will, at our discretion, work to reschedule the trip or offer a travel credit for future bookings. No refunds will be provided for interruptions, cancellations, or delays caused by these events.
  1. Client Early Departure:
  • If a client chooses to leave the trip early for any reason, no refunds or partial refunds will be provided. This includes, but is not limited to, personal reasons, injury, or dissatisfaction.
  1. Travel Insurance Requirement:
  • We require all clients to purchase comprehensive travel insurance that covers trip cancellations, medical emergencies, and other unforeseen circumstances. Chile Off Track will not be held liable for any costs incurred by the client due to lack of insurance.

⊕ Insurance:  Chile Off Track should be informed of the details of this insurance (name of insurance company, identification number of the client) in order to be able to assist more efficiently in case of an emergency. It is worth considering that some aspects of nature are unpredictable and that we must be prepared for any inconvenient circumstances. We will send you a liability form along with your invoice.

⊕ Limitation of Liability: Chile Off Track contracts with a network of companies, government agencies and individuals to assist in the running of our tours as agent for these third parties. We are not responsible for the acts and omissions of these third parties. To the fullest extent permitted by law: any liability for any loss, death, injury or damage which you may suffer (directly or indirectly) in connection with or arising out of your participation in a tour, or any breach of the Terms and Conditions, is excluded; you release us and our officers, employees, agents and representatives from any liability and expressly waive any claims you may have against us arising out of or in connection with your participation in a tour; and any condition or warranty which would otherwise be implied by law into these Terms and Conditions (Implied Warranty), is excluded.

⊕ Photos and Marketing: You give us your consent to use images of you taken during the tour for advertising and promotional purposes in any medium we choose. You grant us a perpetual, royalty-free, worldwide, irrevocable license to use such images for publicity and promotional purposes.

⊕ Lost or Forgotten Items: Chile Off Track is not responsible for any lost or forgotten belongings during our tours. While we will make every reasonable effort to locate and return lost items to their rightful owners, we cannot guarantee their recovery.

If an item is found and can be returned, the customer is responsible for covering all associated costs, including shipping or transportation fees. We recommend double-checking your belongings before leaving our vehicles, venues, or tour locations.

⊕ Optional Activities: Optional activities not included in the tour price do not form part of the tour or this contract. You accept that any assistance given by your tour guide or local representative in arranging optional activities does not render us liable for them.

⊕ Acceptance of Risk: Depending on the tour you choose, you acknowledge its adventurous’ nature and participation involves a degree of personal risk. You will be visiting places where the geographical attributes present dangers and physical challenges greater than those present in our daily lives. We use information our own contacts in assessing whether the itinerary should operate. However it is also your own responsibility to acquaint yourself with all possible relevant travel information and the nature of your itinerary. You acknowledge that your decision to travel is made in light of consideration of this information and you accept that you assume the personal risks attendant upon such travel.
